Ayuda Health, Inc. (“Ayuda Health,” “we,” “us,” or “our”) respects the privacy of its users (“you” or “your”) and is committed to protecting it through our compliance with this Privacy Policy. This policy describes the types of information we may collect from you or that you may provide when you download, install, register with, access, or use the Ayuda Health mobile application (the “mobile application”)—and our website www.ayudahealth.com (the “Site”), and our practices for collecting, using, maintaining, protecting, and disclosing that information. Please read this notice carefully to understand what we do. If you do not understand any aspects of our Privacy Policy, please feel free to contact us as described at the end of this policy.

As we may update the Privacy Policy from time to time, and any changes posted to the Site are effective immediately, we strongly encourage you to revisit the Privacy Policy page on the Site for the latest updates. If you do not agree to the Terms of Use and/or the terms of this Privacy Policy, we recommend that you do not use the services provided by the Site or our mobile applications.

Scope: Third-party Sites

This Privacy Policy applies only to information we collect at and through the Site and mobile application.  Our Site also contains links to third-party sites that are not owned or controlled by Ayuda Health.  Please be aware that we are not responsible for the privacy practices and/or policies of such other sites.  We encourage you to be aware when you leave our Site or mobile applications, and to read the privacy policies and statements of each and every website or application that collects personal information.

Information We Collect

Why We Collect Your Information

When you use our Site, mobile application, and/or any other services provided by Ayuda Health, you consent to the collection, storage, processing, disclosure, and other uses of your information as described in this Privacy Policy.

Processing of your personal/identifiable information subject to your consent, is necessary for the performance and delivery of our contractual obligations towards you, the delivery products and services as agreed to our partners, compliance with legal, regulatory, financial, and other obligations, and protection of our legitimate interests.

How We Collect Your Information

You may use the Site without registering an account or providing personal information. Use of the mobile applications require account registration and the provision of personal information such as your name and email address. Full functionality of the mobile application will require the provision of additional personal and identifiable information and personal health information. 

We will collect information through the use of cookies, web beacons, data from your mobile device or the device(s) you use to access the Site or mobile application, and geolocation data, and any personal or health information you provide us voluntarily. This information requires your consent and is protected under the applicable laws.  

If you choose to register an account on the mobile application and complete your profile  – you will be asked to provide personal and health information. Providing your personal and health information is completely voluntary; however, if you choose not to provide this information, the availability and use of features on the mobile application may be limited. 

Whenever you submit information via our Site or mobile application  or contact our customer support via email or telephone, you may be asked to provide personal and/or health information in order to field your inquiries and provide service.

What Personal Information We Collect

We collect information you provide to us, for example, when you create or modify your account, register to use our Site or mobile application, purchase products or services from us, request information from us, contact customer support, or otherwise communicate with us. This information may include your name, email address, telephone number, credit card or debit card number (solely for payment purposes through a third-party), date of birth, gender, and other information you choose to provide to us through our mobile application.

In order to use the full features of our mobile application, you will be asked to provide personal health information such as the name or type of medications or supplements you have been prescribed, the dosing schedule of those medications or supplements, the conditions with which you have been diagnosed by a healthcare professional, vital sign, symptom, and/or healthcare appointment information you choose to provide.

If you add a caregiver to your profile on the mobile application, you will be asked to provide the name, email address and/or phone number of the caregiver. The caregiver will be contacted via email to confirm the addition of their information to your profile. If they confirm and consent to the addition of their information to your profile, their email address will be used to send notifications of your activity on the mobile application. The caregiver can opt out of the use of their information by accessing  the “Unsubscribe” link in the email.

While using the mobile application, we may request your consent access to other applications on your mobile device such as your camera. This access can be denied to the mobile application at any time via adjusting the settings on your mobile device.

In order to provide accurate service, the mobile application will require access to your mobile device geo-location feature. 

What Non-Personal Information We Collect

We collect data on your use of our Site, including the device, operating system, and web browser used to access the Site, and the location from which you accessed the Site, and the Site pages accessed. 

We use Google Analytics, a web analytics service provided by Google, Inc. (“Google”) to collect certain information relating to your use of the Site. Google Analytics uses “cookies”, which are text files placed on your computer, to help the Site analyze how users use the site. You can find out more about how Google uses data when you visit our Site by visiting “How Google uses data when you use our partners’ sites or apps”, (located at www.google.com/policies/privacy/partners/). We may also use Google Analytics Advertising Features or other advertising networks to provide you with interest-based advertising based on your online activity. Please note that if you choose to opt out, you will continue to see ads, but they will not be based on how your online activity.

We and our service providers use cookies, web beacons, and other technologies to receive and store certain types of information whenever you interact with our Site through your computer or mobile device. A cookie is a small file containing a string of characters that is sent to your computer when you visit a website. When you visit the Site again, the cookie allows the Site to recognize your browser. Cookies may store unique identifiers, user preferences and other information. You can reset your browser to refuse all cookies or to indicate when a cookie is being sent. However, some Site features or services may not function properly without cookies. We use cookies to improve the quality of our services and programs, including for storing user preferences, tracking user trends, and providing relevant advertising to you. 

We collect data on when and how you use our mobile application such as the following: the mobile device used, the device’s operating system; the browser or wi-fi used to access the mobile application.

No Information from Children Under Age 18

This Site is intended for use by individuals 18 years of age and older. Parents or legal guardians over the age of 18 may open accounts with us for their own use and use by their minor dependents. If you are under the age of 18, please do not attempt to register an account with us at this Site or provide any personal, identifiable, confidential, or sensitive information about yourself to us anywhere on the Site, mobile application, or any services provided on the Ayuda Health servers.  If we learn that we have collected personal information from a child under the age of 18, we will promptly delete that information.  If you believe we have collected personal, confidential, or sensitive information from a child under the age of 18, please contact us at support@ayudahealth.com.

How We Use and Share Your Information

We may use the personal information you consent to provide us for business operations, optimal product and service delivery, and fielding any of your technical or customer service inquiries.  

We may also use your personal information to communicate to you via multiple channels such as emails and via the mobile application notifications regarding topics such as medication/supplementation dosing, adherence, and lifestyle modification plans, based on your inputs on the mobile application. We may communicate with you via email regarding changes to our Terms of Use or Privacy Policy, technical or service updates or changes to our mobile application, products, and services.  We may also send you promotional content regarding our offerings or those of our partners, to which you may unsubscribe at any time by clicking on the “unsubscribe” button or link found in every marketing or promotional communication sent to you via email. In the event that you unsubscribe to marketing or promotional communications, your personal information may still be used for product and service delivery, and to field customer service or technical inquiries. Additionally, we may conduct research and analytics to improve our products, services, the Site, and/or our mobile application, and may need your personal information to conduct surveys or feature testing.

Additionally, we may use your personal information to protect our rights and property and those of our customers and partners; to protect ourselves from fraud, liabilities, and risks to security and the integrity of our products, services, Site, mobile application, to defend ourselves against third party allegations, and to conduct investigations necessary to protect the rights, property, and interests of Ayuda Health.

Lastly, we may use your personal information to enforce policies such the Terms of Use, this Privacy Policy, and/or any policy applicable to Ayuda Health operations, and to comply with legal and regulatory requirements.

With Whom Do We Share Your Information (Third Parties)

We may share your personal information to the extent necessary with our vendors and providers of services required for the operation of Ayuda Health, including our products and service offerings, Site, and mobile application, and who are bound by duty of confidentiality.

We may also share your personal information with law enforcement, legal advisors and consultants, courts, tribunals, and governmental authorities, in order to respond to such legal requests, or pursuant to a requirement imposed by law, order, judgment or decree, or courts in order to protect and defend our rights and property or those of users of our services, Site, or mobile application. Your personal information will not be used for other purposes, except as explained in this Privacy Policy. Please note that we are not subject to medical secrecy obligations.

How We Use Aggregated Data

We may use your personal information to generate aggregated data which will not contain data used to identify you. These data may contain health-related information and information on your use of the Site, mobile application, or other services, combined with similar information from other users, to generate aggregated data for our internal use (such as for research, marketing, or service improvement), or may be disclosed to and/or used by our partners or third parties.

How We May Transfer (Including International Transfers) and Retain Your Information

Personal information may be transferred to and maintained on computers and servers located outside of your state, province, country, region, or other governmental jurisdiction where the privacy laws may differ from or may provide lower data protection standards those in your jurisdiction. If you are located outside of the United States, please note that information you provide and we collect may be transferred to, stored, and/or processed in the United States unless otherwise noted. If you reside in the United Kingdom (UK) or the European Union (EU), please note that some of our service providers may be located outside the EU or European Economic Area. In such cases, we will transfer your data only to such countries approved by the European Commission as providing adequate level of data protection, or enter into legal agreements ensuring an adequate level of data protection in accordance with the current instructions provided by the EU commission.

We may transfer our databases containing your personal information in connection with the transfer or sale of all (or substantially all) of our business assets, or in the event of an acquisition, merger, consolidation, or similar transaction.

 

We will retain your personal information for as long as necessary to provide our services through (but not limited to) the Site or mobile application. We will retain and use your information as necessary to comply with our legal and regulatory obligations, to resolve disputes, to protect our rights and property, and to enforce our policies. Retention periods will be determined considering the type of information that is collected and the purpose for its collection, and considering the requirements applicable to the situation.

How We Protect Your Information

We institute stringent technical, physical, managerial, and operational measures to help prevent unauthorized access, disclosure, and use of your personal information. Your data are stored on secure servers which are not publicly available. We limit access of your information only to those employees or partners who need to know the information necessary to enable the carrying out of our business operations or agreements among us.

While we strive to protect your personal information to ensure confidentiality, no security system is inerrable and/or impenetrable, and we cannot absolutely guarantee its security. You should be aware that there is always some risk involved in transmitting information over the internet. We cannot ensure or warrant the security and privacy of your personal information or other content you transmit using our services, Site, and/or mobile applications, and you do so at your own risk.

It is strongly recommended that you prevent unauthorized access to your mobile application user account by protecting your password as appropriate and limiting access to your account (for example, by logging out or signing off after you have finished accessing your account). You will be solely responsible for keeping your password confidential, and for all use of your password and your user account, including any unauthorized use.

Please note that emails and other communications you send to us through our Site are not encrypted, and we strongly advise you not to communicate any confidential or sensitive information through these means.

Based on the information we collect, we allow you to exercise certain choices, rights, and controls in connection with your information. Depending on your relationship with Ayuda Health, your jurisdiction, and the data protection laws that apply to you, you have the right to control and request certain limitations or rights to be executed. We comply with applicable laws and respect the privacy rights of our users. Access to Your Information and Choices

You can access and update certain information we have relating to your online account by signing into your account and going to the account settings section of our Site.  If you have questions about personal information we have about you and/or need to update your information, you can contact us at support@ayudahealth.com. You can opt-out of receiving marketing and promotional emails from Ayuda Health by using the opt-out or unsubscribe feature contained in the emails.

You can deactivate or delete your user account on the mobile application by going to the account settings section.  If you delete your user account, we will no longer use your account information or share it with third parties.  We may, however, retain a copy of the information for archival purposes, and to avoid identity theft or fraud.
